In safety and compliance conversations across manufacturing and industrial environments, one phrase continues to surface: “We’ve always done it this way.” While often said with confidence, this mindset can quietly introduce significant OSHA compliance risks and expose organizations to preventable incidents. Familiarity can create a false sense of security. When a task has been performed the same way for years without incident, it becomes normalized—even if risk is present. During a recent workplace assessment, a facility had rearranged a machine on the production floor. Historically, employees used a bench as a crossover point to step over materials and access another part of the process. However, after the machine was moved, the floor surface underneath the bench became uneven. The once-stable crossover point became unstable and began to wobble. Employees were now faced with a decision: continue using the unsafe bench or walk around the machine, which added time and disrupted productivity. Most safety programs don’t struggle because they lack data—they struggle because they’re measuring the wrong things.

If your organization is tracking dozens of metrics but still seeing incidents, low engagement, or recurring risks, the problem isn’t effort—it’s focus.

Something we hopefully will never have to deal with…

Work is a haven for us. We spend more time working than with loved ones at home in some occasions, and we should feel the same sort of safety from home in the workplace. As we have seen in the years past, workplace violence has become more and more frequent. There are many theories as to why that is, be it reactive culture, social media, or behavioral burdens, among others; however, we must be prepared to face these events in a safe and effective manner. So what can we do?

Practice

Emergency Action Plans in workplaces require drills for certain emergencies. The most common is fire evacuation, but there are also practice events for tornadoes, bomb threats, chemical releases, etc. Workplace violence is a bit more challenging, but well-thought-out practice scenarios will ensure employees are prepared for the unexpected.

Training

So what methods must we employ and practice regarding workplace violence? The common methods are three simple words: Run, Hide, or Fight. These simple concepts can help protect employees, but they need to be informed of what they mean in your situation. Annual (or more frequent if necessary) training in this emergency is a must. A simple conversation goes far. In my auditing experience, when discussing these matters with employees, they make assumptions about procedures because they haven’t been practiced. Having these conversations with employees opens their eyes to possibilities they wouldn't think of in a crisis.

So, let’s get to it.

Run

The best option by far. Removing yourself from a hazardous situation is the safest thing for you to do. In conversations I have had, most people tell me they go to the muster points for fire evacuation so they can escape. While I appreciate the fact that they know they must leave, talking to employees to remind them that they become targets in that case makes them reconsider their training. DO NOT CONGREGATE ANYWHERE . Call 911 once you are safe with as many details as you can muster. The point of the training will emphasize the importance of finding a unique and different route to ensure they are not followed and that the assailant is not simply waiting for them

Hide

The next best option for self-preservation is to find a place to hide. A lockable door, a windowless room, and an area with lots of potential for hiding yourself are the keys here. We want to find a place where the intruder will not look, but you have protections in the room in case they find the area. Do not make noise, and do not open the door unless it is a law officer or public safety official. This typically leads into the third option

Fight

The last resort. When faced with this option, find something heavy that can be used to knock a weapon loose, such as a fire extinguisher, chair, pipe, or something similar. You are looking to incapacitate the intruder. Do not hesitate if the situation gets to this point.

A Quick Guide for Industrial and Manufacturing Facilities

Each year, thousands of facilities across the United States must report chemical releases under the EPA’s Toxic Release Inventory (TRI) program. If your facility manufactures, processes, or uses certain chemicals, you may be required to submit a TRI Form R report.

Many companies do not realize they meet TRI reporting thresholds until they take a closer look at their operations. Understanding the basics can help your facility stay compliant and avoid costly penalties.

What Is the Toxic Release Inventory (TRI)?

The Toxic Release Inventory (TRI) is a federal reporting program established under the Emergency Planning and Community Right‑to‑Know Act (EPCRA).

The program requires certain facilities to report how they manage specific chemicals, including:

Releases to air, water, and land
Recycling and treatment
Energy recovery
Waste disposal

This information provides transparency to communities and regulators about chemical management and environmental impacts. Facilities submit this information using TRI Form R, or in limited cases, Form A.

Who Must File a TRI Form R?

A facility must generally report under TRI if it meets all three of the following criteria:

Covered Industry Sector

TRI reporting applies to many industrial sectors, including manufacturing, chemical production, metal mining, electric utilities, hazardous waste treatment, petroleum bulk terminals, and certain federal facilities.

Employee Threshold

The facility has 10 or more full‑time equivalent employees.

Chemical Activity Thresholds

Facilities must report if they manufacture, process, or otherwise use listed TRI chemicals above EPA thresholds, such as:

25,000 pounds manufactured or processed
10,000 pounds otherwise used

Lower thresholds apply for persistent bioaccumulative toxic (PBT) chemicals.

What Activities Might Trigger TRI Reporting?

Facilities sometimes exceed TRI thresholds without realizing it.

Common triggers include:

• Use of solvents or degreasers
• Metal fabrication, welding, or plating
• Combustion from boilers, generators, or furnaces
• Use of coolants or cutting fluids
• Chemical storage or bulk chemical use
• Waste treatment operations
• Combustion byproducts such as lead compounds or hydrochloric acid

In some cases, the reporting trigger is not the chemical purchased, but byproducts created during normal operations.

When Is TRI Reporting Due?

TRI reports must be submitted annually by July 1 for the previous calendar year.

For Example:
Chemical activity in 2025 → TRI report due July 1, 2026
Reports are submitted electronically using the EPA’s TRI‑MEweb reporting system.

What Are the Penalties for Not Reporting?

Failing to submit required TRI reports can result in significant EPA penalties.

Civil penalties can exceed $60,000 per violation per day depending on the situation.

Facilities may face enforcement actions for:
• Failure to file required reports
• Late reporting
• Incomplete or inaccurate reports
• Failure to maintain supporting documentation

Ladder Inspection Safety At-A-Glance

Ladders of all types are useful in the workplace. They are tools that allow workers to safely reach another level. Working at elevated levels poses plenty of risks, ones that have been covered in many regulatory training courses you have attended. Walking, Working Surfaces and Fall protection all focus heavily on the different hazards, of which SEA would be honored to share with you, but today, I want to focus on what needs to happen prior to using the ladder.

The Right Tool for the Job

And make no mistake, ladders are tools, and only perform as well as we, the operators, allow them to. So, what do we need to consider when picking the right ladder for our job? Several key factors include, but aren’t limited to:

What are we doing? What style do you need?

Step Ladders, extension ladders, and platform ladders all serve different purposes!

What is the weight limit of my ladder?

Note that the weight limit includes you and all the tools/equipment you are wearing, including fall protection!

What height do I need my ladder to be?

Ladders come in all shapes and sizes, so ensure you pick one that allows you to not put yourself at risk, even if it takes a little extra time to go and get it!

What material should my ladder be made of?

Most ladders are fiberglass but also come in several other materials. Make sure you plan for the task and don’t pick a metal ladder when working with electricity, for example

The Most Important Step

After choosing the ladder for our task, we need to perform an all-around inspection of the ladder. How often do we need to perform this inspection? Does it need to be documented? Ladders must be inspected before every use to ensure that no damage has occurred. As far as documentation goes, it is required that a documented inspection occur once a year, but your company policy can dictate more frequent documented inspections.

What are we looking for?

When doing a ladder inspection, you must look at all aspects of the ladder to ensure compliance and safety. A comprehensive list can be found here, but can vary ladder to ladder, so be sure that you are checking the ladder instructions for all aspects of your ladder.

Check the following:

Unfold the ladder and place it on a level surface
Use this time to check the feet to ensure that they are firm, undamaged, and keep the ladder level
Check the spreader braces to ensure they are not damaged, or rusty, and that the locking mechanism is functioning properly
Check the rails to ensure they are not cracked, have heavy sun damage, or are not bent
Ensure the steps are not bent, rivets broken, or supports missing
Check accessories like the rope/pully system on extension ladders to ensure they are in proper working order
Double check to ensure all labels are in place, such as the proper use stickers, do not step above this step, weight restrictions, ladder type, etc.
Ensure these labels are in place! They are required to be there by law, and the ladder is considered defective without them.

Sometimes it takes a real-life moment to remind us how quickly routine tasks can turn into injuries.

Recently, I had a reminder of just how quickly something simple can turn into an injury.

I was hanging a picture frame at home. Nothing complicated—just one of those quick projects you knock out in a few minutes. I picked the frame up by the sides to move it into position.

As I lifted it, the bottom of the frame suddenly gave out.

The glass dropped straight down and landed directly on the top of my bare foot.

Within seconds, what started as a simple task turned into a trip to urgent care. The cut was deep enough that I ended up needing eight stitches.

Looking back, there were a few things I didn’t think about in that moment. I was barefoot. I didn’t consider the possibility that the frame might break. I didn’t think about what could happen if the glass slipped or fell.

It really wasn’t a dangerous job. I wasn’t using power tools or heavy equipment. I was just hanging a picture.

But that’s the reality of many injuries—they don’t happen during obviously dangerous activities. They happen during everyday tasks when we assume nothing will go wrong.

The same thing happens at work all the time.

Many of the injuries we see in the workplace don’t come from the big, obvious hazards. They come from routine tasks—the things we do every day without much thought. Carrying materials from one place to another. Reaching for something on a shelf. Moving equipment a few inches. Cleaning up an area before heading home.

Because we’ve done these things so many times, they start to feel automatic. Familiarity makes them feel safe. We stop thinking about the small risks involved because nothing bad has happened before.

But it only takes one moment—one slip, one unexpected break, one object falling—to turn a normal task into an injury.

A box shifts unexpectedly while lifting.
A tool slips out of someone’s hand.
A surface is slicker than expected.
A piece of equipment fails in a way no one anticipated.

Suddenly, something routine becomes a first aid incident or worse, a trip to the hospital.

That’s why one of the most important parts of safety isn’t just recognizing the obvious hazards—it’s staying aware during the simple tasks we perform every day. The ones that feel routine. The ones we’ve done a thousand times without a problem.

Because sometimes the tasks that seem the safest are the ones that catch us off guard.

My picture frame certainly did.

And it was a good reminder that whether we’re at work or at home, a little awareness can go a long way in preventing injuries.

It also reinforces that safety is a shared responsibility, not just a box to be checked on a form. California's OSHA lead standard updates, which took effect in January, represent a significant shift for health and safety professionals across the state. The new regulations lower exposure thresholds and action levels, necessitating a comprehensive approach to lead monitoring, medical surveillance, and worker protection. Each year, as the Occupational Safety and Health Administration (OSHA) releases its list of the top 10 workplace safety violations, a pattern emerges that begs a question: Are these frequent violations a sign that employers continue to struggle with the same safety issues, or does it reflect a disposition among OSHA inspectors to focus on areas where they are trained to focus?

The Persistent Issue of Repeated Findings

The repetition of certain violations year after year might seem surprising, but it underscores a significant challenge in workplace safety management. The top violations tend to be those that are most visible and easiest to spot during inspections, such as fall protection and hazard communication. This consistency suggests that while awareness is high, practical implementation and adherence to safety practices lag behind.

Top 10 Most Cited Health and Safety Standards of 2024

1. . Fall Protection, General Requirements: 6,307 violations

For the 14th consecutive year, fall protection tops the list of OSHA's enforcement priorities. This emphasis is not arbitrary; OSHA has designated fall protection as a national emphasis area, making it a primary focus during inspections. It's often one of the easiest violations to spot without extensive investigation skills. The OSHA standard 1926.501 mandates that employers must provide fall protection systems like guardrails, safety nets, or personal fall arrest systems for workers at risk of falls of six feet or more in construction and four feet in general industry.

Often, the major factor in these violations is human behavior. Many offenders might think, "No one is watching, and this will only take a moment, so it's no big deal." However, this mindset can lead to non-compliance with critical safety measures, putting worker safety at significant risk.

2. Hazard Communication: 2,888 violations

This has been on the top 10 list I believe since its conception. Why? Once again it is so easy to find these violations and even a rookie inspector can win big with these finds. At the heart of Hazard Communication is OSHA standard 1910.1200. This important regulation ensures that employees are fully informed about the hazards associated with the chemicals they work with. Common slip-ups in this area include not having a comprehensive written hazard communication program, insufficient training on hazardous chemicals, and missing or outdated Safety Data Sheets (SDSs). Each of these components is crucial for maintaining a safe working environment, and their importance cannot be overstated. Let's dive deeper into why staying vigilant about Hazard Communication is key to a safer workplace!

3. Ladders: 2,573 violations

Ladders accounted for 2,573 safety violations last year. While I've encountered some exceptional ladder safety programs—where each ladder is numbered, inspected, tagged, and stored securely in a designated area—unfortunately, these are the exception rather than the rule. More often, I see neglected safety programs where ladders go uninspected and continue to be used well past their safe operational life. According to OSHA regulation 1926.1053, it's crucial for employers to ensure that ladders are not only used properly but are also securely fastened and maintained regularly. A common issue found in violations of this standard, specifically 1926.1053(b)(1), is failing to extend portable ladders at least 3 feet above the landing surface. When extending the ladder isn't feasible, securing it with a grasping device is a must to ensure safety.

4. Respiratory Protection: 2,470 violations

OSHA's standard 1910.134 mandates that employers provide respirators to employees when needed to protect them from harmful airborne contaminants. Common violations of this standard include failing to offer necessary medical evaluations, not implementing a comprehensive respiratory protection program, and neglecting to ensure the use of properly fitting facepieces.

Pro Tip: Always take a moment to read the safety pamphlet insert that comes with your respirator. Most of the safety pamphlets start by reminding you that, before using a respirator in a contaminated area, you must perform either a qualitative or quantitative fit test as specified by OSHA 29 CFR 1910.134 or CSA Standard Z94.4—essential safety information indeed! Digging deeper into the pamphlet, you’ll find that the manufacturer sets exposure limits based on the type of fit test conducted.

For instance, with a qualitative fit test, you're approved for exposure up to 10 times the permissible exposure limit (PEL). However, a quantitative fit test raises this approval to 50 times the PEL. This detail is a gem for inspectors and highlights a critical point from Safety Psychology: very few people take the time to read this pamphlet, potentially missing out on crucial safety guidelines. OSHA will check this every time.

5. Lockout/Tagout: 2,443 violations

OSHA standard 1910.147 mandates that employers establish procedures to safeguard workers from accidental machine start-ups or energy releases during maintenance. Violations frequently cited include shortcomings in energy control procedures, inadequate training and communication, and insufficient periodic inspections.

While compliance challenges persist, it’s encouraging to see a significant uptick in safety practices, particularly in the area of lockout/tagout processes. Many companies are now prioritizing the refinement of their safety protocols, enhancing training programs to ensure that all employees understand how to effectively control hazardous energy, and committing to regular audits of their procedures. This proactive approach not only helps in meeting OSHA requirements but also significantly boosts overall workplace safety, demonstrating a growing industry commitment to protecting workers from potential injuries or worse. Let’s keep this positive momentum going and continue to seek out opportunities for improvement in our safety practices.

6. Powered Industrial Trucks: 2,248 violations

OSHA standard 1910.178 strictly mandates the safe operation of forklifts and other industrial trucks. Frequent violations of this standard include unsafe vehicle operations and the failure to provide refresher training or evaluations.

A concerning aspect often overlooked in many workplaces is the occurrence of 'near misses,' which are seldom reported. Near misses, where an incident could have resulted in an injury or property damage but narrowly avoided, are critical indicators of potential hazards. Their underreporting can mask underlying safety issues, allowing risks to go unaddressed until a serious accident occurs. This lack of reporting and attention not only increases the hazard potential but also misses vital opportunities for corrective action. By encouraging a culture that actively reports and analyzes near misses, organizations can significantly enhance their safety protocols, preemptively addressing risks and reinforcing a commitment to worker safety.

7. Fall Protection, Training Requirements: 2,050 violations

Fall Protection, under OSHA standard 1926.503, requires employers to provide training for employees exposed to fall hazards. In 2024, the most common violations were due to the failure of employers to implement a fall protection training program. It's critical to note that fall protection has been the number one issue cited by OSHA for 14 consecutive years.

With today's resources like Learning Management Systems (LMS), training matrices, and varied training platforms—ranging from traditional on-site instructor-led and online instructor-led, to self-paced online courses—there's no excuse for not having properly trained employees. Failing to provide adequate fall protection training is not just a regulatory misstep; it's a significant legal liability. Inadequate training can lead not only to hefty OSHA fines but also to severe civil penalties following an incident.

For example, in recent years, there have been numerous cases where companies faced substantial financial losses due to civil lawsuits following fall-related incidents. It's a question that might raise a few eyebrows during a job interview, but one of the best Environmental, Health, and Safety (EHS) Managers I know—and a dear friend—makes it a point to ask every candidate this very question. The responses? Always enlightening.

The Occupational Safety and Health Administration (OSHA) was created with a noble goal: to ensure safe and healthful working conditions by setting and enforcing standards, and by providing training, outreach, education, and assistance. There’s no denying the vital role these standards have played in reducing workplace injuries and fatalities. However, as with any regulatory framework, the implementation in the real world can sometimes be a little less than ideal.

Good Intentions vs. Reality

OSHA standards are crafted with the best intentions, aimed at providing universal solutions in diverse industries. Yet, the practical application often reveals significant discrepancies between the theoretical safety standards and the on-ground realities faced by industries. This mismatch can lead to frustration among safety professionals who strive to maintain compliance while ensuring real workplace safety.

The Quirks of Interpretation

One of the main challenges with OSHA standards is their interpretation. The OSHA Letters of Interpretation are meant to clarify the standards, but they can sometimes complicate compliance efforts. These interpretations can vary significantly, leading to confusion among EHS professionals about the best course of action.

The hazards posed by combustible dust are often underestimated until it's too late. These fine particles, when suspended in the air under certain conditions, can lead to catastrophic explosions, resulting in severe injuries, fatalities, and the destruction of buildings. For example, a tragic incident occurred in a metal processing plant where a combustible dust explosion resulted in the loss of several lives and substantial property damage. This serves as a stark reminder of the potential dangers lurking in what might seem like harmless dust accumulations. While the Occupational Safety and Health Administration (OSHA) has yet to establish a specific standard for combustible dust, it recognizes the severity of these hazards through its National Emphasis Program (NEP) (CPL 03-00-008). This program aims to guide inspections targeting industries known for frequent or severe dust-related incidents, including agriculture, chemical manufacturing, and recycling operations. OSHA also provides valuable guidance materials to help businesses understand and mitigate these risks.

What Qualifies as Combustible Dust?

Combustible dust can come from a variety of sources, including both organic and metallic materials. These are finely divided particles such as:

Metal dusts, including aluminum, magnesium, and some iron forms.
Wood dust.
Carbon-based dusts like coal and carbon black.
Organic dusts from sugar, flour, paper, rubber, soap, and dried blood.
Dusts generated from human and animal food processing.
Textile fibers and dust.

These materials may seem innocuous in larger chunks, but as dust, they can burn rapidly and explosively under the right conditions.

The Dynamics of Dust Explosions

A combustible dust explosion is more complex than a typical fire. It requires five elements— known as the "dust explosion pentagon":

Oxygen (from air)
Heat (from an ignition source)
Fuel (the combustible dust itself)
Dispersion (a cloud of dust particles in a sufficient quantity and concentration)
Confinement (an enclosed or semi-enclosed space)

If any element of this pentagon is missing, an explosion cannot occur. However, once ignited, the dust cloud can lead to rapid and violent combustion, often manifesting first as a primary explosion within process equipment or enclosed spaces, followed by secondary explosions as additional dust is disturbed and ignited.

Preventative Measures and Safety Programs

To effectively manage these risks, OSHA recommends conducting thorough hazard assessments that cover:

Materials handled.
Operations conducted, including by-products.
All spaces, even those less obvious.
Potential sources of ignition.

Implementing a written combustible dust safety program is a best practice for any facility handling potentially explosive dusts. This program should:

In a significant move to enhance public safety and environmental justice, the U.S. Environmental Protection Agency (EPA) announced on March 1, the finalization of amendments to the Risk Management Program (RMP). Dubbed the "Safer Communities by Chemical Accident Prevention Rule," this landmark regulation introduces the most protective safety provisions in history for chemical facilities, particularly targeting industry sectors with high accident rates. The rule is designed to shield at-risk communities, especially those in overburdened and underserved areas, from the devastating impacts of chemical accidents. EPA Administrator Michael S. Regan emphasized that this final rule is a vital component of the Biden-Harris Administration's commitment to advancing environmental justice by implementing stronger safety requirements for industrial facilities and new measures to protect communities from harm.

Key Provisions of the Rule

The final rule mandates more stringent measures for prevention, preparedness, and public transparency, with the aim of preventing accidental releases of dangerous chemicals that could lead to fatalities, injuries, property damage, or environmental harm. Key provisions include:

Safer Technologies and Alternatives Analysis : Regulated facilities are now required to perform an analysis of safer technologies and alternatives. In some cases, they must implement reliable safeguard measures to reduce the frequency and severity of accidents.
Empowering Workers: The rule advances employee participation, training, and decision making in facility accident prevention. It allows for process shutdowns in the event of a potentially catastrophic release and establishes a process for employees to anonymously report unaddressed hazards.
Third-Party Compliance Audits: Facilities with a prior accident history must undergo third-party compliance audits and conduct root cause analysis investigations. - Enhanced Emergency Response: Facilities must ensure timely sharing of chemical release information with local responders and establish a community notification system for impending releases.
Climate Change Considerations: Facilities are required to evaluate risks of natural hazards and climate change, including potential power loss, and increase transparency by providing access to RMP facility information for nearby communities.

The Impact of the Rule

The rule covers all 11,740 regulated RMP facilities across the country, with more rigorous requirements for a subset of facilities that are more accident-prone and pose the greatest risk to communities. According to EPA estimates, accidental releases from RMP facilities cost society more than $540 million each year. Approximately 131 million people live within three miles of RMP facilities, including 20 million who identify as Black or African American, 32 million as Hispanic or Latino, and 44 million who earn less than or equal to twice the poverty level.

The rule will be published alongside a query tool which will allow people to access information for RMPs in nearby communities . The agency intends to update the tool in the coming months to allow visualization of climate change hazards, a request of several stakeholders.

When it comes to remote work, OSHA applies a consistent set of criteria to determine if an injury is work-related. Injuries caused by factors related to the general home environment are typically not considered work-related and are therefore not recordable. To illustrate this, OSHA provides examples to clarify the distinction.

1. Home Environment-Related Injuries:

Imagine an employee who tripped over the family dog while rushing to answer a business phone call. In this case, OSHA would classify the injury as not work-related, as it resulted from a non-work-related aspect of the home environment.

On the contrary, ergonomic injuries such as carpal tunnel syndrome from computer use or back injuries from poor posture while working at home are likely to be considered work-related by OSHA since they directly relate to job tasks, rather than the general home environment.

Traveling Scenarios:

Injuries occurring during job-related travel are generally considered work-related, but OSHA draws a distinction between normal commutes and business travel.

1. Normal Commute vs. Business Travel:

OSHA doesn't explicitly define a "normal commute," but it typically refers to the daily journey from home to a fixed work location and back. Injuries during this regular commute are not considered work-related.

However, travel between job sites or to another city for business purposes is classified as work related travel. For instance, if an employee drives a considerable distance to a facility they visit only occasionally and gets injured in a car accident, OSHA is likely to classify the injury as work related.

2. Hotel Stays:

Employees traveling for business may stay in hotels, creating a "home away from home." In such cases, OSHA advises employers to assess injuries by applying the criteria used for injuries at home. If the injury is directly related to the job, it's considered work-related. However, injuries that occur in hotel facilities like the pool or exercise room are typically not work-related.

Meeting with Clients or Customers After Hours:

When employees meet with clients or customers after regular working hours, OSHA considers these injuries work-related only if the employee engaged in the activity "at the direction of the employer." OSHA 2024 Update: Are You Ready for the Digital Shift?

Unpacking the future of workplace safety: Dive into OSHA's groundbreaking changes and stay a step ahead!

Recently OSHA announced a new rule for electronic injury and illness recordkeeping which will take effect starting January 1, 2024. The new rule represents an important shift on OSHA’s part toward more transparent reporting of the safety and compliance of private and public companies. Highlights of this rule include:

Certain establishments with 100-plus employees will be required to submit their OSHA 300 and 301 forms digitally; to date, only OSHA 300A summaries have been required for many organizations.
OSHA will post a portion of the data collected from OSHA documents for public viewing on its website, increasing the visibility of safety incidents and the risk of exposure of employees' personal information.
New industries will now fall under OSHA requirements. These include:
Logging
Hunting and trapping
Furniture-related product manufacturing
Miscellaneous durable goods merchants
Taxi and limousine services
Other support activities for transportation

New OSHA electronic recording-keeping rule starting 2024

OSHA’s new electronic record keeping rule will impact nearly all establishments with 100-plus employees. In the past, these establishments just had to submit their OSHA 300A Summary once per year. However, with this new rule, starting January 1, 2024, these establishments will be required to submit additional data from OSHA Form 300 (Log of Work-Related Injuries and Illnesses) and Form 301 (Injuries and Illness Incident Report).

Additionally, OSHA intends to make some of this data accessible to the public on its website. Although OSHA has stated they will use scrubbing technology to remove any personally identifiable information, we recommend companies remove sensitive personal information– such as names, date of birth, individual contact information, etc.–when submitting data to OSHA under the new rule.

According to OSHA, “the benefits of collecting and publishing data for improving safety and health outweigh potential privacy problems.” Those benefits include the ability for OSHA to:

Identify high-risk workplaces and provide targeted assistance to companies
Allow researchers to identify workplace injury and illness-related trends
Determine whether current prevention methods are effective
Inform job seekers and investors of an establishment’s workplace conditions
Encourage employers to prevent workplace injuries and illnesses

Assistant Secretary of Occupational Safety and Health Doug Parker highlights that "Congress intended for the Occupational Safety and Health Act to include reporting procedures that would provide the agency and the public with an understanding of the safety and health problems workers face, and this rule is a big step in finally realizing that objective.”

Turning Up the Heat on Safety: How OSHA's Upcoming Rule Impacts Your Business and How SEA Can Guide You Through!

The Occupational Safety and Health Administration (OSHA) is preparing to launch a pivotal regulation that will lay out comprehensive requirements for employers. These rules will detail how businesses should prevent and address heat-related illnesses and injuries in their workforce, regardless of whether the work is indoors or outdoors.

Background :

This advanced rule, originally introduced in 2021, is nearing its final stages. Upon completion, OSHA will invite further public commentary. However, once formalized, legal battles might delay its implementation for an extended period. Interestingly, OSHA is now keen on gathering insights from small businesses, particularly those most likely affected by these standards. One might question why this wasn't a priority earlier. This outreach is part of a mandatory small business impact study. Failing to carry out this study could weaken the rule's legal standing, especially if businesses feel OSHA has overstepped. OSHA has specifically requested feedback from sectors like warehousing, agriculture, construction, manufacturing, oil and gas, waste management, utilities, food service, and landscaping. The rule also awaits White House review. With President Biden previously voicing strong support for OSHA's heat-focused initiative, approval seems likely.

Potential Rule Content:

Union perspectives will undoubtedly shape the rule. For instance, OSHA has been particularly vigilant with Amazon, given the ongoing nationwide union-organizing campaign targeting its distribution centers. OSHA's National Emphasis Program (NEP) has also spotlighted the warehousing industry, pushing for intensified inspections.

The focus is on immediate responses to heat hazard complaints and hospitalizations. The goal is to encourage proactive employer interventions to mitigate heat-related issues.

Despite the prevalent concern about heat-related risks, OSHA had never formalized a regulation addressing this. Enforcement was generally anchored on the General Duties Clause of the OSH Act, which mandates a safe and healthy workplace for employees.

Several companies, including Amazon, have innovated with temperature controls and heat safety protocols. For outdoor workers in construction, road repair, and utilities, battling the summer sun remains a challenge.

Notably, 26 states with OSHA-approved state plans have specific laws on occupational heat exposure. OSHA's new rule might integrate existing state standards and insights from recent enforcement initiatives.

NIOSH's Suggestions:

OSHA has collaborated with the National Institute for Occupational Safety and Health (NIOSH) on the rule's content. NIOSH's recommendations include:

Using machinery to reduce strenuous manual labor.
Gradually acclimating workers to heat over a 7 to 14 day period.
Restricting new workers to 20% of typical hot environment work time initially, increasing 20% daily.
Promoting regular water intake (a cup every 15-20 minutes).
Ensuring access to shaded or cooled spaces.
Keeping an eye on complicating factors like alcohol consumption or low-grade infections.
Offering cooled clothing or fluids and using reflective attire for those in industrial settings.

Presently, OSHA advises maintaining temperatures between 68◦ F and 78◦ F, providing water and breaks, and preparing workers for the heat. OSHA has also curated a detailed guide to help businesses prevent heat illnesses.

Employers are advised to familiarize themselves with these guidelines, ensuring safety and preparation for any OSHA evaluations or the eventual implementation of the new rule.

Ensuring Employee Accountability: A Call for Citing Employees Under OSHA's General Duty Clause

The principles of workplace safety and health have primarily been focused on employer responsibilities, as they are primarily the ones shaping work conditions. Yet, as we further delve into the complexities of occupational safety, it becomes increasingly apparent that employees play a crucial role. While employers must certainly continue their efforts to foster safe work environments, it is also vital that employees be held accountable for their actions regarding safety, and this can be done by citing OSHA's General Duty Clause, Section 5(b).

The Occupational Safety and Health Act's General Duty Clause, Section 5(b) states that each employee must comply with occupational safety and health standards. This includes all rules, regulations, and orders issued under the Act, which apply to their actions and conduct. Traditionally, enforcement of this clause has been indirect, with employers bearing the brunt of penalties for employee non-compliance. However, a more direct approach could have a profound impact on overall workplace safety.

With this in mind, it is essential to discuss the Employee Misconduct Defense, a tool that employers can use to reduce OSHA fines. This defense comprises four elements: 1) written safety rules, policies, and procedures; 2) adequate safety training; 3) self-inspection and auditing; and 4) documented discipline for safety infractions.

By having clear, written safety rules, policies, and procedures, employers lay a foundation of expectations for employee behavior. Training is the next essential step; it empowers employees with the knowledge and skills necessary to adhere to safety standards and rules. Furthermore, self-inspection and auditing mechanisms allow employers to ensure consistent adherence to these rules and identify areas for improvement. Lastly, a documented discipline system provides a clear record of steps taken to address employee misconduct, proving the employer's proactive stance towards safety.

Employers often find it challenging to fulfill all these elements. However, doing so not only strengthens their defense against potential OSHA penalties but also enhances their safety culture. If every employer embraces this rigorous approach, employees would be well-equipped with the necessary knowledge and be aware of the consequences of their actions.

Studies have shown that a high percentage of workplace accidents are due to human error, often resulting from negligence or non-compliance with safety protocols. According to the National Safety Council, 85% to 98% of all workplace accidents are caused by employee mistakes, whether due to carelessness, fatigue, or disregard for safety rules. Despite the measures employers put in place to minimize these hazards, the implementation of safety procedures is largely dependent on the actions of the employees themselves.

Citing employees under Section 5(b) is not a call for punishment or fines, but rather a mechanism to bolster personal responsibility and heighten awareness of safety standards. The objective is not to penalize but to provide constructive feedback that will foster an ingrained culture of safety in the workplace. An understanding of accountability would act as an additional deterrent to negligence and create a more safety-conscious employee base.

The introduction of this practice would also lead to statistical improvements in safety outcomes. With employee errors contributing to 98% of accidents, even a conservative estimate of a 10% improvement in employee compliance due to increased accountability could lead to a significant 9% overall reduction in accidents. This shift could save thousands of lives and prevent countless injuries, considering that, according to the Bureau of Labor Statistics, there were 2.8 million nonfatal workplace injuries and illnesses reported in the United States in 2019 alone.

Moreover, it is not just about reducing accident numbers. A safer workplace results in improved morale, increased productivity, and lower absenteeism. It becomes a virtuous cycle that fosters a healthier, more productive work environment for everyone.

Therefore, it is in the best interest of all parties involved to consider this proposition. A citation under Section 5(b) could serve as a wake-up call for an employee to reassess their approach to safety. Employers gain a safer, more productive workforce, and society as a whole benefits from a reduction in the number of workplace accidents and fatalities. By holding every member of the workforce accountable for maintaining a safe and healthy workplace, we can create a culture that truly values safety and continually works toward its betterment.

OSHA's New Heat Stress NEP Is In Effect. Are You Ready?

On April 8, 2022, OSHA launched a National Emphasis Program (NEP) to protect workers from heat illness and injuries in general industry, construction, maritime, and agriculture. The NEP requires each OSHA region to increase the number of heat inspections by 100 percent over the past five-year average.

OSHA will proactively initiate inspections in over 70 high-risk industries in indoor and outdoor work settings when the National Weather Service has issued a heat warning or advisory for a local area. Initial follow-up inspections will be conducted for establishments that were previously inspected as a result of a heat-related fatality and were issued citations.

On days when the heat index is 80°F or higher, OSHA inspectors and compliance assistance specialists will engage in proactive outreach and technical assistance to help stakeholders keep workers safe on the job. Inspectors will look for and address heat hazards during inspections, regardless of whether the industry is targeted in the NEP.

What do you need to do now?

Assessment of high-risk areas is a must to quickly and accurately evaluate potential heat stress environments and determine what controls are practical to minimize or eliminate this potential hazard.
Develop a Heat Stress or Temperature Extreme Management Plan that addresses your areas that are applicable conditions such as Hot, Cold, Windy, Wet, etc.

To say that 2020 was a challenging year may be the understatement of the decade. The way we socialized, work, and especially training/learning was set on new pathways.

THE CHALLENGE

For any company, coordinating a successful training event is always a vast undertaking. For a participant to truly learn, they must first be willing to engage in the subject. And for them to engage in the subject, they must be active in the learning process. Studies have shown that what adults recall in the learning process depends on how active a person is in the training. “People remember 90 percent of what they say and do as opposed to 30 percent of what they see and hear. 1. Inadequate Fall Protection (1926.501) – 6,721

Slips and falls on construction sites and in manufacturing plants are the number one reason employers receive OSHA citations. According to OSHA guidelines, you must determine if working and walking surfaces have the structural integrity and strength to safely support your employees.

Guardrail systems, personal fall arrest systems, and safety net systems must be in place before you allow your employees to work in areas of higher elevation. Employees using a hoist must also be protected from falling six feet or more by personal fall arrest or guardrail systems.

2. Minimal or Missing Hazard Communication (1910.1200) – 5,192

To avoid violations of hazard communication, you must ensure that the labels on hazardous chemical containers have not been defaced or removed and that the safety data sheets associated with these chemicals are accessible to your employees during each shift.

You, as the employer, must also provide OSHA-approved training to any employee handling hazardous chemicals. The improper handling and disposal of hazardous waste are a health risk to both your employees and your community.

3. Unsafe Scaffolding (1926.451) – 4,295

Scaffolds and scaffolding components that are incapable of supporting their own weight plus four times the weight of its maximum intended load (workers) are a commonly cited OSHA violation. In addition, suspension ropes and all connecting hardware should support six times or more the maximum intended load transmitted or applied to the rope holding up the scaffolding.

4. Improper Respiratory Protection (1910.134) – 3,305

If you fail to provide your employees with the equipment necessary to protect their health, you could be issued an OSHA citation. Respiratory protection is essential for employees working around harmful gases, dust, smokes, vapors, fogs, and sprays.

OSHA lists dozens of different respiratory protectors that are expected to be used by employees working in specific hazardous situations. Some of these respirators include positive pressure, supplied air, and pressure demand respirators. If OSHA finds your employees are not wearing the correct type of respirator according to their guidelines, you will be cited and fined. Familiarize yourself with the proper respiratory protection for your industry’s work environment and implement the correct regulations accordingly.

5. Lockout/Tagout (1910.147) – 3,002

This violation can occur when unexpected energization or startup of your business’s machines or equipment could harm an employee. This is an important regulation for the safety of employees who are required to repair or service heavy equipment and for employees who have to work in proximity to conductors and other electrical hazards.

To avoid injury, you must utilize both lockout devices – a device that ensures machinery cannot be powered on until the device is removed – and a tagout device – a tag that clearly indicates the use of an energy isolating device. Tagouts ensure that machinery is not used until the device blocking power is safely removed.

Preventing OSHA Violations

Although OSHA representatives may seem overly exacting during an inspection, these common OSHA violations are all avoidable job hazards that can be prevented with the proper training and instruction from a qualified safety consultation firm.

WHAT YOU CAN LEARN FROM ASHLEY FURNITURE’S MISTAKES TO AVOID OSHA VIOLATIONS

Looking at a company’s safety failures can push your company forward in understanding what not to do when it comes to workplace safety.

A recent OSHA investigation determined that Ashley Furniture had endangered several thousand workers at its Arcadia, Wis., manufacturing facility. Since 1982, the agency has conducted 33 federal inspections and 23 state plan inspections of Ashley Furniture. The company disputes the allegations.

Building a Culture of Safety

The subtitle of the OSHA press release of February 2, 2015, reads: “Largest furniture retailer in the U.S. exposes employees to amputations, other hazards.” After a worker lost three fingers in a woodworking machine accident in July 2014, the U.S. Department of Labor’s Occupational Safety and Health Administration conducted an inspection of the furniture manufacturer’s Wisconsin facility.

The agency concluded that over 1,000 workplace injuries had occurred over a three-and-a-half-year period. The “12 willful, 12 repeated, and 14 serious safety violations” could cost Ashley Furniture $1.7 million in penalties.

At least 10 percent of the injuries shared the same cause: machines that started unintentionally when workers changed tools or blades. It was found that the risk could be easily remedied with inexpensive, emergency stop safety mechanisms. In the “penny wise, pound foolish” category of misplaced priorities, the company appears to have cut safety corners and now faces a far greater loss in steep fines.

Along with exposure to faulty equipment, the workers were not properly trained in safety when servicing the machinery. Company-imposed pressure to work quickly to meet deadlines and increase productivity was another contributing factor.

OSHA discovered that workers were being exposed to corrosive materials because the facility lacked adequate drenching and flushing procedures. Engineering controls that minimize employee exposure to chemical hazards by either reducing or removing the hazard at the source, or isolating the worker from the hazards, were lacking. Three electrical safety violations were also cited.

A willful OSHA violation is one committed with intentional, knowing, or voluntary disregard for the law’s requirement, or with plain indifference to employee safety and health. OSHA maintains that Ashley Furniture knew of the existing hazards and was willfully and intentionally negligent. The company has also been placed in the Severe Violator Enforcement Program for failure to address these safety hazards.

It’s a bit surprising to learn of the multiple risks that the largest furniture manufacturer in the country took with employee welfare, company reputation, and company capital. OSHA ANNOUNCES ISSUANCE OF MORE SECURE TRAINING CARDS

OSHA 10 and OSHA 30 training can improve worker safety and reduce worker’s compensation claims. The growing success of this program has led OSHA to take steps to improve course completion security.

March 2019 – Little Rock, AR – SEA Inc., a major industrial safety, environmental services and training company, has announced that its long-running OSHA safety training program for manufacturers, construction companies, and other industrial customers will be adopting new, more secure student course completion cards consistent with recent guidance from the Occupational Safety and Health Administration (OSHA).

SEA’s OSHA safety courses are part of OSHA’s Outreach Training, a program that gives individual workers and their supervisors structured safety training that helps them recognize, avoid, and address safety hazards in the workplace. Studies have shown that workers who have participated in safety training programs report fewer accidents resulting in significant reductions in workers compensation claims.

There are four general classes of training under Outreach OSHA safety training. The Construction Industry program is for workers employed at residential and commercial building sites. The Maritime program provides courses for employees of shipbuilders, marine terminals, and related on-shore facilities. The Disaster Site training is for workers involved with demolition and clean up in the wake of natural and man-made disasters. Finally, there is General Industry training, which supports those working in manufacturing and other industrial settings.

In each of the four general classes of Outreach training, workers can participate in a 10-hour (OSHA 10) or a 30-hour course (OSHA 30). OSHA 10 is intended for entry-level employees. OSHA 30 is for supervisors and/or those with broader safety responsibilities. Trainers giving these courses receive special OSHA certification and are authorized to issue student course completion cards.

The need for more secure student course completion cards has been driven by the Outreach Training Program’s increasing acceptance. While employers are not required by OSHA to participate, some cities and states are now mandating OSHA 10 for construction workers. This has led many companies to require job applicants to have already completed the OSHA 10 or OSHA 30 course.

In addition, other companies are making Outreach Training an integral part of their in-house safety programs. Over the past five years, some 3.6 million workers have participated in Outreach OSHA 10 or OSHA 30 training.

The new course completion cards will be more durable than the current paper cards and will include the student’s name, trainer, training date, and the name of the OSHA Training Institute that sponsored the course. The cards will also include a QR code that can be used by employers to check the employee’s name against a database of trainers and students.

WHY YOUR EMPLOYEES NEED TO BE DOT HAZMAT TRAINED

If your company handles hazardous materials, even occasionally or in an indirect way, your employees may need DOT hazmat training. Non-compliance with DOT regulations is both illegal and dangerous.

If your employees come into contact with hazardous waste as part of their job description, they need to be trained in handling hazardous materials according to the standards developed by the U.S. Department of Transportation (DOT). Failing to comply with DOT hazmat training can have serious and costly consequences for your business and the health and safety of your workers.

Who Needs DOT Hazmat Training in Arkansas?

U.S. DOT hazmat training regulations apply to any company that has employees who perform duties that are in any way governed by the DOT Hazardous Materials Regulations, including:

Packaging, labeling, or marking hazardous materials for transport

Loading, unloading, or transporting hazardous materials

Receiving or forwarding hazmat items

Creating or testing hazardous materials packaging

Additional training is also required if the DOT issues any new hazmat rules or revises existing ones.

These rules apply to all companies regardless of size or the amount of hazardous materials they process. Non-compliance with DOT hazmat training can be expensive. If an inspector finds training violations, the minimum fine is $450 per employee, per day, and can be as high as $75,000 per day for each violation.
